Meta’s updated commercial terms have raised concerns among news publishers over the potential use of their website content to train AI models without payment. Effective October 30, 2026, the terms allow Meta to use automated tools to collect and analyse content, reigniting the debate over AI, copyright and publisher compensation.

Meta’s updated commercial terms have sparked concerns among news publishers over the potential use of their website content to train and improve artificial intelligence (AI) models without compensation. The new terms, which take effect on October 30, 2026, allow the social media giant to use automated tools, including web scrapers, bots and crawlers, to access, collect and analyse content from websites associated with businesses using its platforms.

The terms also state that Meta may use content collected from these websites to train, develop and improve its products and AI features. The development has raised questions about copyright, consent and whether publishers should receive payment when their original reporting contributes to commercial AI products.

Meta’s New Terms Raise Concerns Among Publishers

The changes were first which consulted legal experts about their potential implications for news organisations. James Grimmelmann, a professor of digital and information law at Cornell Law School, warned that the terms could give Meta permission to use content from publishers’ websites to train AI models and potentially compete with the organisations producing that content. Most major news organisations maintain a presence on Facebook, Instagram and other Meta platforms to distribute stories, manage pages and reach audiences. The updated terms have therefore raised concerns about whether content from their websites could be collected through these business-related arrangements.

Big Tech’s Growing Demand for News Content

The debate comes as technology companies increasingly rely on large volumes of online information to develop AI-powered tools. News content is particularly valuable because it includes original reporting, interviews, investigations and analysis of current events. Meta Unveils Muse Wonder AI Models with Advanced Memory and Focus Capabilities.

Google has introduced AI-powered search features that provide users with summaries and answers directly on search pages. OpenAI has also faced legal challenges and criticism from publishers over the use of copyrighted material to train AI models.

Publishers argue that producing original journalism requires significant investment, including paying reporters, editors and other newsroom staff. They are concerned that technology companies could benefit commercially from this work without providing adequate compensation.

Could AI Reduce Traffic to News Websites?

Another concern is the potential impact of AI-generated answers on publisher revenue. News organisations depend on website visits to generate advertising income and attract subscribers. If users obtain information through AI summaries without visiting original sources, publishers could lose valuable traffic.

Smaller newsrooms may be particularly vulnerable because they have fewer financial resources to absorb declining revenue.

    Publishers Seek Clarity on Compensation

Meta’s updated terms have renewed calls for greater transparency around how online content is collected and used to develop AI products. Publishers want clarity on whether they can refuse permission, how their reporting will be used and whether they can negotiate compensation.

The broader debate highlights a central question for the AI industry: how can technology companies develop new products while ensuring that the journalists and publishers responsible for producing original information are treated fairly?
