The U.S. Citizenship and Immigration Services (USCIS) is increasingly using artificial intelligence (AI), machine learning, and government information systems to examine immigration applications. The Department of Homeland Security (DHS) has publicly identified several AI systems used by USCIS for document processing, identity matching, and other administrative functions. These technological developments are changing how immigration records can be reviewed and scrutinized.

USCIS has access to information through various government systems and authorized data-sharing arrangements. E-Verify works with records maintained by DHS and the Social Security Administration. USCIS can also access certain Department of State immigration and visa information. Information held by the Internal Revenue Service is subject to separate legal restrictions.

At Reddy Neumann Brown PC, we have recently observed an increase in Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs), and Notices of Intent to Revoke (NOIRs), sometimes involving relatively minor discrepancies in immigration records.

For example, an H-1B employee’s paychecks or W-2 statements may appear inconsistent with the wages listed in the Labor Condition Application (LCA). Although legitimate explanations may exist, such differences can invite additional scrutiny.

Similarly, information provided on a DS-160 visa application may differ from details submitted in a subsequent H-1B petition, extension, or green card application. Differences involving employment history, salaries, job titles, addresses, or previous immigration information may raise questions.

“An answer you gave at a visa interview ten  years ago could come back to haunt you today.”

Artificial intelligence makes it easier for government agencies to organize large volumes of records, identify patterns, and flag potential inconsistencies. However, DHS has not confirmed that USCIS automatically compares every paycheck, LCA, DS-160, and tax record through AI. Nor is there evidence that AI independently makes immigration denial decisions.

Nevertheless, the direction is clear. Technology is becoming increasingly important in immigration screening and enforcement.

We strongly recommend that employers and employees carefully review immigration filings, payroll records, prior visa applications, and employment information before submitting new applications. Any discrepancies should be identified and properly explained.

The days of assuming that minor inconsistencies will go unnoticed are becoming increasingly risky. Accuracy, consistency, and proper documentation are more important than ever.
